Obligations of User/Subscriber Collection and Use of Information by 24x7

In some areas of 24x7, we request or may request that you provide personal information, including but not limited to your name, address, e-mail address, telephone number, credit card number, contact information, billing information and any other information from which your identity is discernible. In other areas, we collect or may collect demographic information that is not unique to you such as your code, age, preferences, gender, interests and favorites. We also gather or may gather certain information about your use of 24x7, such as what areas you visit and what services you access. Moreover, there is information about your computer hardware and software that is or may be collected by us. This information can include without limitation your IP address, browser type, domain names, access times and referring Web site addresses, but is not linked to your personal information.

All the information below sets forth the online data collection and usage policies and practices that apply to the 24x7 Web Sites (sometimes referred to herein as the "24x7 Sites") and does not apply to information we collect in any other fashion. Your data will be stored and processed in whole or in part in the United States. The information we gather on the 24x7 Sites may be shared within the 24x7 - affiliated companies on a worldwide basis in order to deliver the products and services we offer to employers such as searches for job seekers or in order to undertake analysis of our database such as aggregate profiling of our registered users. The 24x7 Sites contain links to other Web sites over which we have no control. We are not responsible for the privacy policies or practices of other Web sites to which you choose to link from our Sites. We encourage you to review the privacy policies of those other Web sites so you can understand how they collect, use and share your information. We supply technology, hosting and related services to other leading companies to power recruitment areas on their Web sites (sometimes referred to as "Hosted Career Sites"). Personal and/or demographic information supplied by you in Hosted Career Sites becomes part of the 24x7 database, but it is not accessible by anyone other than you, 24x7 and the company concerned without your consent. If you attempt to register with 24x7 after registering with a Hosted Career Site, 24x7 will recognize your information and you will be able to use the information you provided to the Hosted Career Site in your account registration

Obligations of User/Subscriber

You must be 18 years of age or older to visit or use 24x7 in any manner. By visiting 24x7 or accepting these Terms of Use, You represent and warrant to the Company that You are 18 years of age or older, and that You have the right, authority and capacity to agree to and abide by these Terms of Use. You also represent and warrant to the Company that you will use 24x7 in a manner consistent with any and all applicable laws and regulations.

The accuracy of the Registration Data given to the Company on initial application for the Service shall be the sole responsibility of the User.

Any licenses, permits, consents, approvals and intellectual property or other rights as may be required for using the Service shall be obtained by the User at his own cost.

The User will ensure compliance with all notices or instructions given by the Company from time to time to enable the use of the Service.

The User shall be solely responsible for all information retrieved, stored and transmitted through the Service by him.

The User shall keep confidential and not disclose to any person the User’s password and user identification and all activities and transmission performed by the User through his user identification.

The User shall immediately notify the Company of any un-authorized use of the User’s account or any other breach of security known to the User.

The User shall be responsible for the set-up or configuration of his equipment for access to the Service.

24x7 in its sole discretion shall reserve the right to edit, modify and alter the content.

Security of the Personal Information

We have implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes

Links to Other Sites

24x7 and certain other 24x7 Sites contain links to third party web sites. These links are provided solely as a convenience to you and not as an endorsement by the Company of the contents on such third-party Web sites. The Company is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk.

No Resale or Unauthorized Commercial Use

You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of any Recruitpro Live Site.

Indemnity

You agree to defend, indemnify, and hold harmless the Company, its affiliates, and their respective officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to any 24x7 Site, (ii) your use of any 24x7 Content, or (iii) your breach of the terms of these Terms of Use. The Company shall provide notice to you promptly of any such claim, suit, or proceeding.

Terms and Termination

These Terms of Use will remain in full force and effect while you are a User of 24x7 at any level. The Company reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to deletion of your User Content from 24x7 and the other 24x7 Sites and immediate termination of your registration with and/or ability to access 24x7 and the other 24x7 Sites and/or any other services provided to You by the Company, upon any breach by You of these Terms of Use or if the Company is unable to verify or authenticate any information You submit to 24x7 or other 24x7 Site registration.

Limitation of Liability

The maximum liability arising out of or in connection with any 24x7 site or your use of the 24x7 content, regardless of the cause of action (whether in contract, breach of the warranty or otherwise) will not exceed Rs. 100.

Disclaimer

The company does not warrant that any 24x7 Site will operate error-free or that any 24x7 and its servers are free of computer viruses or other harmful mechanisms. If your use of any 24x7 Site or 24x7 content results in the need for servicing or replacing equipment or data the company is not responsible for those costs. 24x7 sites and 24x7 content are provided on an “as is” basis without any warranties of any kind. The company to the fullest extent permitted by law disclaims all warranties whether expressed or implied including the warranty of merchantability, fitness of a particular purposes and non- infringement. The company makes no warranties about the accuracy, reliability, completeness or timeliness of the 24x7 content, services, software, text, graphics and links.
